The drugmaker is in a fight to keep the cost of its erectile dysfunction medication from soaring by $1.6 billion, a steep drop compared with its 2008 peak of $4.6 billion.
But the drugmaker is not in a quandary, as the price of its top-selling erectile dysfunction drug is set to rise at a steep discount, as it battles to keep more of its $1.6 billion in profits.
A $1.6 billion price battle has also emerged between the drugmaker and other major drugmakers, as drugmaker Eli Lilly faces an increasingly intense competition from rival Pfizer Inc.'s rival GlaxoSmithKline (GSK) for about $1.1 billion in annual revenue.
Despite the decline in revenue, the drugmaker said on Thursday it will maintain a lower patent on its drug, which has been dubbed the "little blue pill."
The patent for Levitra, an FDA-approved medication to treat erectile dysfunction, expires next year. The company will continue to market the drug under the name Vardenafil, though its stock has been declining since it lost its best-selling drug in 2010, in part due to a legal challenge by the European Union.
The drugmaker, which is based in Israel, said the decision to stop selling the drug had hurt its bottom line. The company has said its market share has fallen 8 percent since the patent was approved in 2003.
But pharmaceutical company GlaxoSmithKline has said the decision to discontinue its sales of its Vardenafil, an erectile dysfunction drug for men, could lead to a significant decline in revenue. It said revenue was expected to decline more than 10 percent in the coming months.
GSK has said it would cut its workforce of one full-time employee by more than 5,000 people, including its executive vice president, Dr. Sharmia Ali Al Zuckerman.
The decision to stop selling the drug will come after a court ruling that the company had a legal and valid patent to promote Vardenafil.
However, Al Zuckerman, the company's chief executive officer, said the company has made other moves to maintain its market share.
"We are in a very strong position and we continue to work hard and make good progress with our medicines, and we are confident that we will continue to do that," he said in a conference call with analysts.
GSK has said it has agreed to pay a $1.6 billion settlement with the United States Food and Drug Administration (FDA) for the alleged infringement of the Vardenafil patent. A similar settlement was reached in 2011, with Al Zuckerman and his company being sued by generic drug makers.
In the United States, the FDA has approved a version of Viagra that is similar to Levitra, but has an identical active ingredient to the one used in Levitra. Viagra is available in both blue and white, the FDA-approved drug.
GSK said it is planning to file a generic version of the drug with the FDA in a few months. The company said the FDA has also asked the drugmaker to submit a new patent for Vardenafil.
"We look forward to engaging with our U. S. patent attorney and other pharmaceutical companies to work together to defend our patents," said Brian St. John, CEO of GSK.
GSK's stock fell $3.58 on the first day of trading in the fourth quarter after it reported a 52 percent fall in profit. It has been struggling to keep its earnings per share and profit from the drug.
For a company that accounts for $3.9 billion in annual revenue, the loss of earnings would add to the company's revenue of $1.5 billion to $2.3 billion. But the stock's gains are driven by the drugmaker's patent woes.
The company has said the patent for Vardenafil expired in March, but analysts are predicting the patent will expire in September.
GSK, which is based in Israel, is expected to launch a generic version of its erectile dysfunction drug in the next two years, with a cheaper generic version expected in the coming months.
In its earnings report for the fourth quarter, the company said earnings for the fourth year totaled $2.4 billion, up $0.04 per share, or 14 percent, and net income totaled $2.3 billion, up $0.12 per share, or 16 percent, compared with $2.2 billion, or 15 percent, for the prior year year quarter.
